| Tartalmi kivonat: | This paper investigates how the different administrations contributed to the construction of the enemy image of Guantánamo Bay detainees and how it appeared in their legislative processes following the 9/11 terrorist attacks. The unprecedented and transnational nature of global terrorism provided lawmakers with new, unforeseen challenges they needed to address and overcome. Shocked by the attacks, the Bush administration assumed a socalled reactionary approach that was motivated by fear of future attacks which resulted in problematic and questionable decisions. In an attempt to remedy the damage caused by his predecessor, President Obama used a troubleshooting approach to distance himself from the previous administration but to no avail because President Trump reversed the decisions of the Obama administration based on the ignorant approach he assumed upon election. The Biden presidency has chosen a reticent approach to Guantánamo. By analyzing and comparing presidential speeches, executive orders, and legislative decisions of the Bush, Obama, Trump, and Biden administrations pertaining to the Guantánamo Bay Naval Base, and analyzing the role of international laws in their respective decision-making processes, this essay provides a comprehensive look into the effects and significance of legislative enmification. |
