Tartalmi kivonat:European civil law codes were introduced much earlier than written constitutions. The most influential civil codes in Europe (e.g. the CC., ABGB, BGB.) have Roman law origins (principles, institutions of property law and law of obligations) and they also incorporated the new ideas of the Enlightenment: embourgeoisement, natural law thinking, equal justice under law, sanctity of property, freedom of contract, etc. These notions created the framework not just of the modern economy but also the structure of the society. Therefore, to some extent, they functioned like the modern constitutions. The Hungarian Code Civil may be adressed as the constitution of private law conidering it governs the property and personal relations of person, Furthermore, any legislation concerning civil law shall be interpreted in accordance with the provisions of the Civil Code. The structure of the code is comprehensive: incorporates principles over general rules and clauses to specific regulations. For instance, regarding a contract, firstly the legal capacity and legal competency of parties, secondly the provisions on property (e.g. real property, usufruct, lien) and the law of obligations, finally the articulated structure of the law of obligations (common provisions relating to obligations, general provisions on contracts, provisions relating to type and subtype of the actual contract) shall be examined. Consequently the existence of principles and general provisions is essential not to be get bogged down in the mere text of the lex specialis. Otherwise, it would only indicate formal legality. The principles can be considered diverse and they constantly alter the reality beyond the written law. In my study relevant theories on application of the principles and two concerning cases will be examined, relating the entity and novelty of the “individual” constitutional complaint.
