Tartalmi kivonat: | A contract of inheritance is a special type of testamentary disposition because, unlike a will, it is a bilateral contract and the heir does not receive the inheritance free of charge, but for consideration. It is a contract and a will at the same time. The Hungarian Civil Code regulates the contract of inheritance in a separate chapter of the Seventh Book (Succession Law) after the rules on the will. This situation makes unclear which norms shall apply to the contract of inheritance from the following: the rules on the will, the general rules of succession law, the regulation on maintenance and life annuity contracts, the general rules of obligation and contract law. This problem is discussed in our paper. It can be concluded that, due to the contractual nature of the inheritance contract, many rules of succession law are not – or with limitations – applicable (e.g., disinheritance, liability for debts of the estate), and due to the testamentary nature of the contract, many contractual rules are not – or with limitations – applicable (e.g., representation, pre-contract, nullity of contract). |
