Tartalmi kivonat:Within the European Union, the number of marriages and divorces with an international element to the free movement of persons is increasing. European regulations on the dissolution of cross-border marriages can be said to be almost complete. The Brussels IIa Regulation settled jurisdiction and recognition issues, the Rome III regulation on issues related to the applicable law as an enhanced cooperation, and in 2019, two regulations on the jurisdiction, applicable law, and the recognition and enforcement of decisions were adopted in matters related to matrimonial property regimes and the property effects of registered partnerships as an enhanced cooperation. The Brussels II Regulation was revised in 2019. although the new regulation did not introduce any innovations about matrimonial matters, as marriage is still a politically sensitive topic that Member States are not willing to allow to be regulated by the EU. And due to the different national regulations, there are new questions about divorce, which we have to deal with as a private international private lawyers. In this study, I would like to answer a few questions about out-court divorces, i.e. private divorces, and of the recognition of these decisions made by another member state, taking into account the findings of the judgment of the European Court of Justice made on November 15, 2022.
