Tartalmi kivonat:The lecture given in honor of Prof. Dr. János Martonyi Sr. and the article edited on the basis of it is a tribute to Martonyi’s scientific work. A decisive part of János Martonyi Sr.’s scientific oeuvre is the subject of judicial control of the executive power; the analysis of the Hungarian situation and its international comparative analysis spans his entire life. The aim of this study is to recall some of the professor’s thoughts that are still active today and to relate them to today’s conditions. As will be seen, if we present the current situation, we can go back again and again to the principles laid down by Martonyi, especially at the beginning of his career, during the period of administrative jurisdiction. When the law of administrative court procedure was codified, one of the central legal policy objectives was to achieve seamlessness of judicial protection. When determining the scope of the Code of Administrative Court Procedure, a central issue was the determination of the subject matter of the administrative dispute, which took place as a general clause. After years of polemics, the Hungarian legislator, in line with European development tendencies, left taxation behind. The article presents some recent judicial decisions that interpret and clarify the concept of administrative dispute and certain elements of it in judicial practice.
