Tartalmi kivonat: | The widespread use of the internet and the explosion of social media have led to significant changes in criminal law. Today, crimes of the offline world can also be committed in cyber space, just like online harassment. One case of this harmful act is the so-called “revenge pornography”. This is typically, but not exclusively, preceded by a relationship, where the victim sends intimate pictures or videos of themself to their partner or consents to taking these images depicting them naked. After the relationship has ended, the victim’s ex-partner distributes these images without consent from the motive of revenge. Revenge pornography can not only cause shame and a negative change in the victim’s social image, but can also affect the victim’s existence and, in the most serious cases, can lead to self-harm or suicide. Realizing the seriousness of the phenomenon, many countries have criminalized nonconsensual pornography, but this wave of criminalization has barely reached Europe and there is no sign of such effort in Hungary. Under the current Penal Code (Act C of 2012 on the Criminal Code), revenge pornography is not a separate offence, but the offender’s conduct may fall under several statutory offences. Nevertheless, the current legislation does not provide sufficient protection for victims. During the legal subject matter analysis, I found that the right to privacy and the right to sexual autonomy are also the legal subject matter of revenge pornography, which do not gain an adequate protection in the Hungarian criminal law. These shortcomings can be remedied by criminalizing revenge pornography, which requires a sui generis statutory offence. |
