Tartalmi kivonat: | Coherence between constitutional law and civil law in practice raises a number of dogmatic questions and issues arise in connection with the practice as well. Article I, paragraph (3) of the Fundamental Law of Hungary represents one of these issues and the many questions that it raises, with constitutional values being in the focus of this paper. How to define the concept of these values? Where to place them in the dogmatic framework of constitutional law? How do these constitutional values correlate to fundamental rights? In trying to answer these questions, the existence and content of the common legal values will be examined, along with the role of these values in practice, with a particular view on good morals. It is a question whether we can talk about the emergence of these values in horizontal legal relations as a sign of the disappearance of the strict confines between constitutional (public) and civil (private) law. |
