| Tartalmi kivonat: | As we examine the common points of company law and inheritance law, one of the main questions how the heirs acquire the bequest involving the participation and how the death takes effect on companies. Examining the four types of companies, the inheritance has almost different features: in case of general partnerships and limited partnerships the heirs cannot become members automatically and these companies may terminate because of the member’s death. Contrary to the previous regulation business shares can be inherited in a more simple way and since shares are transferable securities there are no such problems. We also take a look at state inheritance and the bases of Austrian regulation. |
