Tartalmi kivonat:In my article I analysed the main theories of the political crime’s concepts which appeared in the 20. century. Next to these legal changes, the opinion of the Hungarian society was changed too in the point of political crimes. According to the 19. century these offenders had been treated like politicans who fight for an idea, but after the I. World War they lost their privileged situation in the Law-Enforcement system. The first Criminal Code was codificated in 1878 which regulated the political crimes quite softly: for example the items of confinements were not strict enough to possess a deterrent force on society, but it is important to emphasise too, that preparation activities stayed unpunishment, independently of the fact that they were probably dangerous for the society. That is why new regulation was necessary in the Criminal law which was suitable to complete the regulation of political crimes. These acts were called, ”orderlaws.” The first were the III. of 1921. on the Effective Protection of the State and Social Order which contained very strict and precisely defined facts of crimes that is why it was able to give an effective protection against the radical political ideas. After the II. World War the Hungarian Criminal Law was fulfilled with the idea of communism and according to this new legal environment another act was created. This was the VII. of 1946. on the Protection of the Democratic State Order and Republic. It is very important to emphasise the fact that this law was more strict than its legislation antecedent and according to its dispositions several show trials were organized by the Communist Party.
