Tartalmi kivonat: | The purpose of the essay is to show the current problems of the Hungarian jurisdiction regarding to freedom of assembly. Generally, I point it out that prohibiting public demonstrations in the area of legal buildings should not be “jolly joker” in the hands of police, just because the Hungarian Act on the Right to Freedom of Assembly (Act III of 1989) makes it available. I examine the rules of civil and criminal procedures in Hungary and I find out that restricting publicity in trials is not an option for judges even if the presence of people is unpleasant for them. Thus, I make a conclusion that prohibiting public demonstrations should not be automatic with reference to judicial independence, especially because restricting publicity in trials is not available for courts just because crowded courtrooms make judges feel uncomfortable. |
