| Tartalmi kivonat: | On September 22. 2016 The Parliament ratified the new Law on Public Procurement as CXLIII. The reason behind to assemble a new Law was the changes and reforms of the European Union (EU) in the Law on Public Procurement. The legistlature of the EU accepted three changes concerning Public Procurements, and these were published in the Law Journal of the EU on March 28, 2014. These new gudelines on Public Procurements should be implermented by the member states not later than April 18, 2016, and parts conerning the electronic Public Procurements should be implemented by the central acquisition organisation not later than April 18, 2017, and contracting tender parties should implement these until April 18, 2018. Accepting these three new guidelines on Public Procurements will complete the overall reform of Public Procurements Law of the European Union. The new guidelines of the EU will mean fundamental changes of the national guideline background, and call for major changes of the national Law of Public Procurements, and these changes would have been inevitable anyway. These changes will be realized through new legistlation and assembling a new Law. In these new rules the broader concept and goal of the overall legistlation is realized, and in specific fields, implementing regulations will complement the process. In my lecture I will show the changes of the new Public Procurement Law, with emphasis of the changes in the negotiations, by the taxative list of the changes in the relevant issues. |
