Tartalmi kivonat:Freedom of contract within civil law, is one of the fundamental principle of the contractual rights, without which in current conditions the great majority of the contracts to be bound would not even come into being, as without this fundamental principle the parties involved would not be masters of their own, as if there were no protection to make their own decisions in connection with the contract based on their free will. Consequently, there is the question of whether this fundamental principle is also a constitutional right or not. Further clarification is needed in the following problem, which are the constitutional rights and interests respectively that may overshadow the need for the freedom of contract, issues concerning the limits of the certain fundamental rights, to which extent the freedom of contract is to be restricted in relation to fundamental rights and where is the limit it should be regarded as of utmost importance. In this study I aim, in the light of the above mentioned, to analyze the nature of the interaction between constitutional rights, interests and freedom of contract.
