Tartalmi kivonat: | The competences of public prosecution shows a great variety in Europe, and its role in the system of power arms, and especially powers outside the criminal law stands in the crossfire of significant debates. Because of historical traditions and the progress of the last decades, non-penal powers of public prosecution are extremely different and diversified in european countries. This paper will present an overview of the most important principles, such as exceptionality, subsidiarity, speciality, legality, which are included in various reports and recommendations of the Europe Council and its institutions. With this paper, I’d also like to point at the emergence of this principles in the Hungarian legal system. |
