Tartalmi kivonat:The present paper is focusing on those cases published in casebooks from the late 1920’s that cover the practice of the Hungarian High Court (Magyar Királyi Kúria) between 1927 and 1933. The analyzed cases were brought before courts by actions for declaratory proceedings in accordance with Article 130 of Act I of 1911. This special action was introduced with the intention to broaden the scope of legal protection in Hungarian private law however the practice of the Court showed that the parties somewhat misinterpreted the use of the action for declaratory proceedings in cases of invalidity and damages claims. Despite the restrictive interpretation of actions for declaratory proceedings by the Court in the above mentioned legal areas, the economic downturn lasting for decades in Hungary though resulted in the widespread application of actions for declaratory proceedings in other matters. In those cases where the Court found action for declaratory proceedings applicable were those in which the substantive law matters covered loan agreements and valorization cases.
