Tartalmi kivonat: | In my study, I aim to examine the role settlements play in public service legal relationships. Through this examination I look for answers whether the regulation of settlements as individual legal institutions within the Public Service Act is justifiable, bearing in mind that this led to a legal institution fundamentally laid on private legal grounds included in a Public Service Act garbed with public legal traits. The question arises whether the regulation of settlements breach the system of public service, aiming to follow the ideals of a career system in the theoretic sense, moreover, how large a relevance it bears in the practical sense. My research indicates that the regulation is justifiable to a given extent, since the Act allows for settlements to be made in many cases. To mention underlying examples, settlements regarding relocation, termination of employment, study contracts, etc. comes to mind. Advantages of forming settlements can be highlighted by the fact that they are capable of driving employment towards flexibility, all the while, due to its dispositivity, it undoubtedly leads to a breach of the career system employed in public service. |
