Tartalmi kivonat:The matter within the focus of examination is the judicial practice regarding the compensation for personal injuries caused by the circumstances of penal institutions, violating the fundamental rights of convicts and detainees of other dues. Binary research questions have been drawn due to the characteristics of the topic. The first one has a civilistic approach and its target is to determine the tendencies of the plaintiffs’ legal claims, the respondents’ defence and the decisions of the courts about the matter at hand. The second is about the execution of penal sentences, and it inevitably stems from the first one: what kind of circumstances can be disclosed from the judgements about the Hungarian penal system. In order to answer these questions empirical methodology is required, thus I have studied ninety-one judicial decisions. Firstly, I construe the plaintiffs’ legal claims: I specify their aim, the supposedly violated personal rights and the phenomena that are assumed to cause these violations. Secondly, I introduce the legal arguments respondents brought up discrediting the claims against them in order to exculpate themselves. Afterwards, I examine the judicial practice. I detail the way courts handle the claims, the relevant regime of liability and its partial requirements. I also advert to the matrix of personal injuries and penal-specific indemnification before, last but not least, answering the research questions. I draft an ideal model about the civilistic issue in which the participants make optimal decisions, each to reach their personal goals, and the court judges on correct dogmatic basis. I suggest solutions regarding the penal question, with which the circumstances that violate fundamental rights can be eliminated.
