Tartalmi kivonat: | The present paper describes the essence, importance, characteristics and different classifications of the basic principles and the attempts and debates regarding the labelling and diverse interpretations of the particular principles. Subsequently, it examines the Introductory Provisions of the effective Civil Code, which mainly consist of basic principles. The paper emphasises the individual right and the lawful interest, the protection of property and persons, the prohibition of the abuse of rights, the requirements of good faith, fairness and cooperation, the requirement of proceeding in a manner deemed reasonable under the given circumstances, the principle of construing and the rule of referring conduct in particular, while also enabling the reader to track the changes (especially those taking place in 1977 and 1991) in time. Finally, the paper describes the changes introduced by the draft of the new Civil Code, which is expected to come into effect in 2010. |
