Tartalmi kivonat: | The essay examines some problems of legal regulation and practice of property rights. In the field of property rights uncertainty can be observed in several respects which has been caused to some extent by the growing importance of the role of constitutional law and of the international system of protection of human rights based on principles and rules differing from those of the private law. Characteristic features of recent practice of the Hungarian Constitutional Court and some elements of the practice of the European Court of Human Rights are outlined in the essay. On this basis it is underlined that there is a need for reconsidering basic questions of property law taking into consideration changes since the transformation of the political system. |
