The study also highlights the “confrontation” of the examined legal instruments. The study presents that the inmates are not in a favorable position when they try to enforce their rights based on violation of housing requirements in prisons. In certain cases, prisoners have to initiate both legal procedures, however it is clearly against the intention of the legislator. Sooner or later the judicial practice must decide which instrument of enforcement it supports in the event of infringement in question. | |
