Tartalmi kivonat:Current study attempts – in the light of the Constitutional Courts relevant practice – to draw a distinction between two separate claim enforcement methods: compensation claims based on housing conditions in prisons violating fundamental rights and civil lawsuits for violation of personal rights. The study also highlights the “confrontation” of the examined legal instruments. The study presents that the inmates are not in a favorable position when they try to enforce their rights based on violation of housing requirements in prisons. In certain cases, prisoners have to initiate both legal procedures, however it is clearly against the intention of the legislator. Sooner or later the judicial practice must decide which instrument of enforcement it supports in the event of infringement in question.
