Tartalmi kivonat: | Criminal dogmatic and case law issues related to certain aspects of the preparatory stage of criminal offence have recently come to the forefront of interest again. This is due to the fact that the Curia's Council for the Unity of Law on Criminal Matters adopted a legal unity decision on the suitability to declare an intention to commit a crime without an invitation, the ruling of which became biding for the courts from 14 November 2019 [3/2019. BJE]. In order to adequately answer the question of classification discussed in the above-mentioned decision, the aim of the present paper is to provide an overview of the theories known mainly in German criminal law, which seek to address the delimitation problems of preparatory criminality. In addition, the paper – considering the presented theoretical conclusions – also analyses the principled guidelines expressed in the legal unity decision. |
