Tartalmi kivonat:The fair use doctrine is a cornerstone of the American Copyright Law, a legal instrument, with which the users of copyrighted works can excuse themselves from the consequences of their unlicensed activity. According to this doctrine the reproduction of materials by photocopying, creating parodies of movies or lyrics, or using any other documents to prepare for example biographies shall not be considered infringement, if the use fits the requirements listed in the Copyright Act. The most interesting characteristic feature of this common law based legal instrument is mainly that its rules were regulated first of all by the fourth Copyright Act in 1976, but the judicial practice — following the English patterns — have started to lay down the foundations already with one and a half century earlier. Similarly to the other legal instruments of the Anglo-Saxon legal systems the fair use doctrine was developed by the judges and adjusted also by them to the requirements of the ages. The present article introduces first the theoretical basis of the doctrine and after it examines its practical development, focusing mainly on the cases decided by the U.S. Supreme Court. The study pays attention to the newest part of the American Copyright Law, the Digital Millenium Copyright Act, which tried to adjust the former rules to the challenges of the digital age. According to this new act the question of fair use burned up with renewed strength in the American jurisprudence, as the frequent legal disputes show it, from which the best-known are the suits against the widespread music download services.
