Summary:On the 1st January 2012 the new Fundamental Law of Hungary comes into force which will slightly modify the legal framework of the labour law as well. In connection of that the legislative body created a new Labour Code which is based on the new constitution. The new regulation emphasizes that the system in operation throughout the past 20 years in labour law failed to fulfil the expectations, and the contractual legal source system of labour law did not evolve in Hungary. Therefore the new legal regulation uses different priorities which will probably effect modifications in the legal connection of the employer and the employee. It will be a serious task for the judicial practice to interpret these new legal rules and at the same time to protect and develop the former results.
