Tartalmi kivonat: | Despite its astonishing economic importance, China has been party only in few investment arbitration cases. The primary aim of this work is to try to find out the reason for this. The work first examines the historical roots of Chinese investment protection from the beginning of the 20th century up until the present day. It particularly looks into the reforms of President Xi Jinping, and the current investment system. This is followed by the examination of the most important investment arbitration cases in which China has been involved. The author came to the conclusion that the main reason for the small number of investment arbitration cases is the slow and gradual opening of the Chinese system towards international trends in this field. The real turning point came with the increase of Chinese investments abroad, when it became the self-interest of the country to protect its investors abroad. |
