Tartalmi kivonat:This study sets out to scrutinize through practical examples the provisions of Act No. CXXXIII on buildings under joint ownership whereby the permission for a refurbishment, rearrangement or a specific activity taking place on joint real estate under separate ownership is subject to the consent of the tenants and, where appropriate, requires the amendment of the statutes of the estate. The study attempts to underscore the view that the single documentary condition of transferring the change in intended use of a building to the land register is a certificate from the planning authority and, consequently, registering the change may take place without the amendment of the statutes.
