Summary:This study deals with the issues of labour law in connection with workplace stress. The actuality of this matter is showed by the European trends, as European social partners signed two framework agreements on this topic in the recent years. The connection between labour law and workplace stress is rather apparent. If the employee suffers damages and the damages and his work may be connected, the responsibility of the employer is to be examined. Workplace stress is a special occupational risk, which needs to be tackled taking into account its characteristics. After a short introduction to the nature of workplace stress, its definition, causes, consequenses and strategies how to handle it, I analyze the points at which workplace stress is attached to the legal system. However, the emphasis is laid on the employers' responsibility and occupational health and safety. In my opinion, there are two ways of solving the problem, which offer the same result: if workplace stress causes damage to the one's health , labour law has to ensure the right to the employee to bring a case and to demand recompense in front of the court. Firstly, a new regulation might be accepted which takes into account the special characteristics of workplace stress. Secondly, the legal situation might be clarified in the framework of the recent regulation.
