Tartalmi kivonat: | The article analyses the most important decisions of the Hungarian Constitutional Court regarding the right to a fair trial, and specifically the principle of equality of arms. In accordance with the practice of the European Court of Human Rights, under the Hungarian constitution the principle of equality of arms is a constitutive element of the fair trial, and of criminal procedure in general. The Hungarian Court in its decisions has given a special emphasis to the right to access to information, namely the procedural right to access to the files of the criminal case. However, the Court stated that these requirements are not of an absolute nature: the restrictions should be necessary and proportionate. |
