It only complicates the situation further, that the constitutional complaint itself branches out into different types, which all demand different conditions to be fulfilled when filing the application; and even the aspects of examination cannot be said to be uniform. The past three years following the introduction of the change have probably not been enough for the Constitutional Court to establish a firmly crystallized practice, however, the substantial points of evaluation can be properly outlined. Next to several questions of detail, the main argument unfolded around the dilemma whether the rights ensured in the Fundamental Law in general, or only those laid down in the chapter Freedom and Responsibility form the basis of constitutional complaints. Therefore the study – mainly on functional grounds – seeks answers to the conflicts arisen from this issue.
