Tartalmi kivonat: | „The status of the ombudsman system (…) can be assessed by describing its structure, powers and judicial activities” - writes Lóránt Csink (Péter Pázmány Catholic University) in his study determining the role of the ombudsman. Altough Professor Csink’s statement refers to modern Hungarian conditions, this threefold criterion can be appropriate considering the Scandinavian insitution, too. A full determination of this particular system will take a longer route: the essay is presenting the role of the modern ombudsman by reviving the historical background of Justitiekanzler while being based on Savigny’s legal sociological theory called Volksgeist. Law is part of our culture, it is inseparable from social development and national habits. For instance, Ole Lando’s detection that Scandinavian citizents avoid ligitation makes equity as the base of the insitution. As the Nordic body of law was indirectly influenced by Roman law, this paper - will unconventionally describe the nature of ancient, complaint mechanisms’ like tribunus plebis and their comparison with the modern ombudsman role. In order to keep the clear flow of thought in this essay, using the almost uniformly legal structure of the Scandinavian countries, Sweden and Denmark will pled the Nordic legal conventions. Finally, as an alternative example, a brief outlook is given reflecting to the global reception, in special interest to European Union. The aim of this study is to illustrate the development of the ombudsman as a legal institution from its Scandinavian conception, through its global diverzification up to the Hungarian model. |
