All three requirements of the development of criminal statistics – a criminal code, a law on criminal procedure and a statistical administration – were missing at the time. Therefore, criminal offences in the period can only be reconstructed using court documents and prison statistics. Violent crimes represented only a fraction of criminal offences committed by women in the Hungarian Reform Era. Women typically committed these at home, against their children or, less frequently, against their husbands. This paper processes the documentation of the criminal procedure of a mariticide in Csanád county in 1820 from the point of view of criminal law and historical criminology. The man was murdered, with his wife’s help, by the wife’s lover, a soldier. The body had not been found, but the perpetrators admitted to the murder. The lover escaped, but the woman was sentenced to death, which was changed to 10 years of imprisonment out of mercy. The advocate of the woman did not dispute her committing the crime but looked for mitigating circumstances. He based his plea on the weakness and suggestibility of the female gender, claiming that the lover had forced the wife to collaborate with him in the crime. The advocate also searched for witnesses to testify to the drunkenness of the husband and marked the man’s low social status as the reason for the bad marriage.
