Since then a provision (ECHR-clause) stating the direct application of the European Convention on Human Rights in the legal system of Bosnia-Herzegovina is part of the state’s Constitution. In order to determine the constitutional identity of BiH – after a brief introduction to the historical context – I present the peculiarities of the governmental and legislative branch imposed by Dayton. The Constitutional Court of BiH made numerous decisions in these fields, out of which I study those concerning the electoral process, with special regard to the sovereignty transfer feature of the ECHR-clause. This is followed by the comparison of the previously analysed case law to a decision of the Hungarian Constitutional Court (HCC) addressing very similar questions related to the interaction between national and international law. Based on the separate opinion of HCC judge András Varga Zs., I summarize the different scientific opinions about the concept of constitutional identity, then draw consequences from the relevant case law of the European Court of Human Rights concerning BiH, and finally suggest expanding the scope of the eternity clause contained in the BiH Constitution.
