520 3 |a Criminal law regulation has undergone a constant change to ensure the undisturbed sexual development of minors, seeking to achieve the most complete protection by increasingly stringent normative means. The legislator sanctions certain forms of sexual conduct differently depending on the age of consent. However, in addition to the measure of the sentence, a difference in the offender specification can also be detected. This results in a different criminal policy assessment despite the same offender behaviours of the factual situations. So the question arised in my mind: why does the legislator make a distinction on the part of perpetrators in the case of similar legal constructions, and whether the legislation in force is able to adequately ensure the legal protection objectives it sets? I placed the examination of noncoercing sexual acts with minors under the age of twelve to the focus of my study, reflecting specifically on juvenile offenders. I have built up my research by first examining the current regulatory model while highlighting some of the problems caused by the lack of perpetrator’s qualification. Then I explored the arguments in favor of defining the offender specification, including the regulatory justification for the age-based criterion of criminal liability for similar offences, and the sexual development of children as the actual appearance of the legal object to be protected, the legal assessment of consensual natured behaviour and certain aspects of penalisation in the field of victimology. Finally I examined how the oportunities currently residing in the dogmatic toolbox of criminal law can possibly ensure the protection of the group of persons I have investigated. I have also shown how the definition of the offender’s age could be included in the framework of the current regulation, because the aim is to create the highest possible level of protection for sexual development.
