Tartalmi kivonat:The law of administrative infractions is a legal area on the borderline between administrative law and criminal law. In the 19th century it belonged to criminal law, since the 1950’s, in a formal sense it has been part of the law of public administration. However, its criminal law roots severed by the law are still strong. In fact, contrary to theoretical efforts, they seem to be strengthening. This may be very well seen from Act II. of 2012, the new Hungarian Code of Administrative Infractions, which openly declares in its preamble that the offences defined in the Code are of criminal character. The provisions of the substantive law of infractions are formulated accordingly. The sanctions have been made heavier, and the newly introduced provisions on repeated perpetration allow the application of the punishment of incarceration in the case of almost any infraction. The author discusses some of the problems related to these facts using a theoretical and doctrinal approach, presents her conclusions and points out the shortcomings of the regulation of certain key issues in the new Code.
